Welcome to Klotz Kapital Ai (“we,” “us,” or “our”). By accessing or using our services, including AI voice agents, chatbots, and automation tools, you agree to these Terms of Service (“TOS”). Please read carefully.
1. Services Provided
Klotz Kapital Ai provides AI-powered services, including but not limited to:
AI voice agents
Chatbots and website widgets
Appointment scheduling automations
AI tools to assist businesses with customer engagement, operational workflows, and coaching support
Services are currently intended for and directed toward businesses. In the future, this scope may expand. Services may be delivered via our platform and integrations with third-party tools (Go High Level, Google Calendar, Stripe, Gmail, Gemini).
2. Eligibility
Users must be at least 18 years old or the legal age of majority in their jurisdiction.
Services are intended for business use, in Canada, but may be accessed worldwide, in compliance with Canadian regulations.
Users may be businesses, entrepreneurs, or individuals seeking AI-powered operational solutions.
By using our services, you represent and warrant that you meet these eligibility requirements.
3. Account Registration & Responsibilities
Users must provide accurate, complete, and up-to-date information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
Users agree to use our services lawfully and not for prohibited activities, including:
Fraud, harassment, or abuse of our systems
Violation of intellectual property rights
Uploading harmful, offensive, or illegal content
4. Payment Terms
Trial Period: First-time clients may receive a free trial lasting 7–14 days to demonstrate results using our AI systems.
Post-Trial Fees: After the trial, clients may be charged:
A flat fee depending on the AI bot selected
A monthly retainer for basic integrations and ongoing support
Customized Agreements / Long-Term Plans:
All long-term agreements must be paid upfront and in full.
Further charges or arrangements may be determined during video-call consultations.
These agreements are only valid if accompanied by a signed contract.
Results Guarantee: If a client enters a long-term deal and specified goals are not met within the agreed timeframe, Klotz Kapital Ai will continue to work for free until the goals are achieved.
Payments are processed through third-party providers (e.g., Stripe).
No Refund Policy: All fees paid for paid services, including post-trial services, retainers, or long-term agreements, are strictly non-refundable, except as explicitly agreed in a signed contract with a results guarantee.
5. User Content & AI Outputs
Users retain ownership of content they provide (business data, prompts, messages).
AI-generated outputs are provided “as is”; Klotz Kapital Ai does not claim ownership of outputs derived from client-provided data.
Users may use AI outputs for their business operations consistent with these TOS.
6. Acceptable Use of AI
AI tools are provided to assist users, not to make final decisions on legal, medical, or sensitive matters.
Users should not rely solely on AI outputs for decisions with legal, financial, or reputational consequences.
Misuse, abuse, or attempts to manipulate AI systems is prohibited.
7. Use of AI Outputs – Client Responsibility
Klotz Kapital Ai provides AI tools to assist your business. You are responsible for reviewing and using any outputs generated by the AI in a lawful and responsible manner. This includes ensuring that any messages, content, or recommendations produced by the AI comply with all applicable laws, regulations, and industry rules in your jurisdiction. Klotz Kapital Ai is not responsible for how AI outputs are used by your business.
8. Suspension & Termination
We may suspend or terminate accounts or access at our discretion for:
Violation of these TOS
Illegal or unauthorized activity
Non-payment
System abuse or security risks
Upon termination, user access to AI systems and stored data may be restricted or deleted. Users may request account deletion at any time.
9. Intellectual Property
Klotz Kapital Ai retains all rights in its software, AI models, content, and platform.
Users retain ownership of content they provide.
By using our services, users grant Klotz Kapital Ai a limited license to process user content for service delivery and AI customization.
10. Disclaimers & Limitations of Liability
Services are provided “as is” and without warranties, express or implied.
Klotz Kapital Ai does not guarantee AI outputs will be accurate, error-free, or suitable for all purposes.
Users assume all risk for decisions made using AI outputs or service data.
To the maximum extent permitted by law, Klotz Kapital Ai is not liable for indirect, incidental, or consequential damages, including business losses, missed appointments, or reputational harm.
11. International Data & Privacy
Data may be stored or processed in Canada and the United States.
Personal information may be used solely to schedule appointments and deliver services.
Business-specific data submitted by clients may be used to customize AI agents for that client’s needs, but personal or sensitive information will never be used to train AI models beyond that client’s system.

12. Governing Law & Dispute Resolution
These TOS are governed by the laws of Ontario, Canada.
Disputes will first be attempted to resolve through good-faith negotiation.
If unresolved, disputes will be settled in the courts of Ontario, Canada.
13. Termination Conditions
Users may terminate their account at any time by contacting us.
Klotz Kapital Ai may terminate accounts for violations, misuse, or non-payment.
Upon termination, user content may be deleted, and AI agents customized for that user may be deactivated.
14. Custom Policies
AI tools may only be used for lawful purposes.
API or service usage is subject to fair use limits to prevent system abuse.
15. Changes to Terms
Klotz Kapital Ai may update these TOS from time to time. Updated TOS will be posted on our website with a revised Effective Date. Continued use of services constitutes acceptance of the updated terms.
